Student Agreement

Purpose

This agreement sets out what the student and the parent or guardian agree to when using TutorMunk. It is accepted by the parent or guardian on the student's behalf at enrolment and forms part of the overall agreement with TutorMunk (ABN: TBC, ACN: TBC).

Who This Agreement Is Between

This agreement is between TutorMunk and the parent or legal guardian who enrols a student. The parent or guardian accepts it on the student's behalf. The student is bound by the student commitments in this agreement through that acceptance.

Student Commitments

The student agrees to:

  • be ready to start at the agreed time, with the books, homework and equipment needed for the session;
  • work in the agreed area of the home or in the room allocated at the centre;
  • treat the tutor and TutorMunk staff with courtesy and respect;
  • take part in the session and attempt the work set between sessions;
  • not photograph, film or record the tutor or the session;
  • not contact the tutor privately, including by phone, message or social media;
  • tell a parent, or TutorMunk, about anything that makes them uncomfortable or worried.

Parent and Guardian Commitments

The parent or guardian agrees to:

  • be present in the home for the whole of every in-home session, or arrange for another responsible adult to be present;
  • sign the session record at the end of each in-home session;
  • provide a suitable, quiet and safe working area in an open part of the home, never a bedroom;
  • secure any dogs or other animals away from the working area, and provide safe access and parking;
  • sign the student in and out at the centre, and tell us in writing who else may collect the student;
  • give accurate information about the student's year, subjects, and any learning, medical or behavioural needs;
  • give the required notice when cancelling a session;
  • pay fees when they fall due;
  • raise any concern or complaint with TutorMunk rather than with the tutor personally.

Where Sessions Take Place

In-home sessions take place in an open, accessible area of the home with a responsible adult present throughout. Sessions do not take place in a bedroom, and a tutor will not work with a student behind a closed door. Where a student is 16 or over, sessions may take place without an adult present only if the parent or guardian has given written permission in advance.

Centre sessions take place at TutorMunk Gregory Hills, The HUB, 31 Lasso Road, Gregory Hills NSW 2557, in rooms visible from outside or with the door open. Staff may observe a session at any time.

If no responsible adult is present at the start of an in-home session, the tutor will not begin, and the session is treated as a cancellation with less than 24 hours notice.

Conduct

Harassment, abuse, discrimination or threatening behaviour by a student, parent or anyone else present, directed at a tutor or staff member, is grounds for immediate suspension or termination of the enrolment. Tutors are equally bound by the TutorMunk Tutor Code of Conduct and may be removed for any breach of it.

Child Safety

TutorMunk has zero tolerance for child abuse, neglect and exploitation. Every tutor holds a current Working with Children Check, verified before their first session. Tutors must not contact a student outside a session, meet a student privately, transport a student in a vehicle, or arrange private tutoring directly with a family.

If the student, the parent, or anyone else has a concern about a child's safety, report it to TutorMunk immediately at hello@tutormunk.com.au or on 1300 00MUNK (1300 006 865). If a child is in immediate danger, call 000. We escalate to the NSW Police Force and to child protection authorities where required by law or where we consider it appropriate.

Session Records and Reports

The tutor writes a short note after every session covering what was taught and what to practise. The note is provided to the parent or guardian. A fuller report is provided each term.

Fees, Cancellations and Refunds

Cancellation and refund terms are set out in the TutorMunk Cancellation and Refund Policy. In summary, 24 hours notice or more means the session is rescheduled at no charge. Less than 24 hours notice, or a no-show, means the session is forfeited and charged, because the tutor has committed the time and in most cases has already travelled.

Pausing an Enrolment

You may pause an enrolment at any time by emailing hello@tutormunk.com.au. Any sessions already paid for and unused are held for you and are available when you resume, subject to tutor availability. Paused enrolments must be resumed within 12 months.

Privacy

Personal information about the student and the family is handled in accordance with the TutorMunk Privacy Policy. By accepting this agreement the parent or guardian consents to that handling, including for a student under 18.

Intellectual Property

Materials produced by TutorMunk, including worksheets, session notes and reports, are owned by TutorMunk. The student may use them for their own study during the enrolment. They must not be copied, sold or shared.

Breach

TutorMunk may suspend or end the enrolment where the student or the parent breaches this agreement, the Terms and Conditions, or where the conditions required for a safe session are not met after we have raised them.

Changes to This Agreement

We may update this agreement from time to time. Where a change is material we will give enrolled families at least 10 days written notice by email.

Acceptance

By accepting this agreement at enrolment, the parent or guardian confirms that they:

  • are the parent or legal guardian of the enrolled student;
  • have authority to accept this agreement on the student's behalf;
  • have read and understood this agreement, the Terms and Conditions, the Privacy Policy and the Cancellation and Refund Policy;
  • understand that a responsible adult must be present for in-home sessions;
  • accept this agreement on the student's behalf and on their own behalf.
